You could try to reopen the case with Supporting evidence of ill health and age. This is a long shot, but a good attroney should be able to pose a compelling argument. Also, try to get an infopass appointment and talk to someone about your options.

I have been offered a job with a company who has an approved labor of Priority date Dec 2002. Seems like a good deal but I wanted to know if Labor Transfer is still possible. I mean Labor can be transfered from someone's name to mine.

Hi all,
Please let me know what could be the problem. On Apr25, my status changed to Case Received and Pending. Last Updated Date is 05/18.
When i contacted my employer, he says my petition is approved. But still when i find the status online, it's not reflected.
What could be the problem?
Any thoughts would be highly aprpeciated.

No that is wrong assumption. H1B can be extended only based on the beneficiary's self I-140 not spouse's
Consult his/your attorney and renew H1B. At least start GC process to be eligible for H1 extension after 6 years

Same thing happen in our case, transfers TSC to local office(FL) for speed processing then after 16 months we got interviews letter from local office to attend the interview.

Make sure you do not travel out of USA before you get your approved AP, since as per the law if the person who filled I485 leaves the country without AP then it is considered that he abandoned his I485, with the exception given to H1B/H4 and L1/L2 (and youdont have any of these)
If you leave USA without AP then you need to restart the process, if you have AP then that is all you need to travel.

My EAD renewal has not been approved and it has been 100 days. I checked with local immigration officer and they dont know as why it is still not processed. USCIS customer service representative says it is within the processing time in Nebraska service center. I efiled EAD and got the biometrics done in June. I am on EAD & can i continue to work if the EAD renewal does not come through befire the current EAD expires ?. Will it affect I485 ?

At this time, we are trying get to all contract details(start to end client) and file new h1b petition (CAP Exempt) on premium processing and Lawyers are suggesting me to go for Counslar Processing.
I want to know What are options have to selected on I-129 for counslar processing (I am going through Lawyer However, I want to ensure that we are selecting right one)
On I-129 Form, Part 2,
Question 2: Basis for Classification (Check one):
a. New employment (including new employer filing H-1B extension).
b. Continuation of previously approved employment without change with the
same employer.
c. Change in previously approved employment
d. New concurrent employment.
e. Change of employer
f. Amended petition
Question 5: Requested Action (Check one):
a. Notify the office in Part 4 so the person(s) can obtain a visa or be admitted.
(NOTE: a petition is not required for an E-1 or E-2 visa).
b. Change the person(s)' status and extend their stay since the person(s) are all

Can spouse leave to home country after filing concurrent i140 and 485 application?
Her and mine application (concurrent 140 and 485) was filed on July 2nd, 2007but I have not received RECEIPT # yet. Can my spouse leave USA or we have to have get Receipt # first ?

thats what I did when I moved back to company A. My lawyer suggested as long as company A did not cancel your H1 approval you are good to go!!..Hope this helps. Good luck.

Use I-134 instead which is used for EB petitions.

I was in a similar situation. I emailed to this address info@phi.dflc.us from my company email. I didn't put anything else ( as per advice in some other forums). Received reply with the case number after a month. Meanwhile I received 45 days letter and so not worried much. As we all know this is a hit and miss. They may reply..but won't hurt to try.

We got our EAD cards today.
We had gone for FP on Sept 19th and saw LUDs on Sep 20th on our I-485s. But the EAD cards came without our fingerprints. EAD cards came from the same Service center (Nebraska) where the FP notices came from. So wondering, how they did not include our fingerprints in the EAD card?? I had also checked with FBI helpline two weeks back and verified that the FPs were delivered to USCIS.
Anybody else in similar situation?

They are big and you can join them without any hesitation. I worked for them for more than 6 yrs. I am not working there any more.
