Hello!
My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!
If I remember correctly, you are allowed to work for 240 days from the receipt date while your case is pending. If the approval does not come within 240 days, you have to stop working and wait for the approval. You are NOT considered out-of-status as long as your petition was filed before the current H1 expired.

I have an employee who was a student and then got employment authorization. She asked me to begin the process of getting her an H1B; but then we determined that she really wanted a green card. Can I use the LCA I got for her H1B to apply for her I-i40?
LAC for H1B and LCA for Green card are entirely different .

Do you mean send one myself or through the lawyer? Who exactly would I send it to?

The process is similar to what one would follow for the regular H1B's. Starts with filing the prevailing wage determination with the labor dept and then filing the I-129 papers with USCIS. The only difference would be the fee, non-profit organizations don't have to pay something like a training fee, (I am not sure). You can file it anytime and start working as soon as you have the receipt number.

I don't have your answer, I just hope that you will be an active and contributing (not just money, time and effort as well) member and will help IV achieve the greatest good in terms of the green card process reform. Ofcourse you will benefit from it yourself.

You should take the advice of an attorney. I would recommend Rajiv Khanna. His website is immigration.com. In case india is the only option, you get lactose free stuff as well.

Is there any way that we can get the USCIS to update their Aug 2007 bulletin and write on top of it and the July bulletin was valid till Aug 17th.
That way any officer who would check the Aug 2007 bulletin would first see the update and go by the July bulletin instead of rejecting I-485's in a bunch which cause additional hardships to the applicant in getting it reopened via MTR and again going through the long process.

I am dependent on our GC application. We had provided initial Finger prints in July 2007. I got an FP notice in 2009 and have just received another FP notice for next week. Meanwhile, the primary applicant on our application has not recd any biometrics appt since the 07 initial set.
Is there anything to be concerned about?

I booked H4 visa appointment in Chennai Consulate on Oct 10th,2007.
My husband is working in US on H1b visa. He moved company A to company B on Sep 10th,2007. He has companyB H1b approval letter, but he only has one Sep month pay stub from company B.
When I am going for H4 visa stamping, I need to submit my husband's recent 3 pay stubs. Can I submit my husband previous company A pay stubs( June to Aug) with recent pay stub from company B. Is there any requirement to submit all pay stubs from one company.
Please assist me. I would really appreciate your answers.

I did not have my I-140 notice, so I emailed my attorney and he replied with a copy of the I-140 which had the priority date.

I have applied I485 when i was in India and it is in pending now.I am back from India and currently in USA now and came to know that one cannot file I485 when the applicant is not in USA.
Should i be withdrawing the pending I485 and reapply now ?since there is a date availability till august 17th 2007
Or Can I appply new I485 without withdrawing the pending I485 .Once I get new receipt notice ,then withdrw the old pending I485?

These are critical decisions and you should consult a knowledgeable attorney ASAP to know your options and possible risks. If you used an attorney to file your 485 from India, then you know that this attorney is no good.
