I just read somewhere...that if I do not file by I140 by July 31 the i lose chance to file I485 by august 17..which i could file anyway together if I have to file it by July31..Is this true..
the reason being that I am waiting for the hard copy of Labor Approval and the only thing I have is Cover letter copy..I do not want to miss chance

I didnt mean to burst your bubble...but may be its just that you are getting another finger printing notice. Its expires in 15 months. If you read the other forums July 07 filers have started getting their next set of FP notices. I wouldnt get too carried away.

Can somebody mention how long it took to get AP approval at NSC ? I applied for AP at NSC on June 12th and I booked ticket for my wife for Aug 3rd, I was going to join her to India and booked my for October, I figured I would carry both the AP's and use it for coming back, now I am reading that AP has to be approved before she leaves or else it is no good. Can some body put their approval times at AP in recent times, so I can decide to change tickets accordingly ?

Found the old J1 Visa stamped in the passport. It does list the 212(e) requirement.
At the time when I got the first H1, I had 2 years, or close to 2 years of accrued stay in Russia. I should definitely have 2 years by now.
What could be the result of not having had full 2 years at the time of first H1? What could be the effect on the currently active H1?
If I show that right now I have 2 full years, would the AOS proceed, or are there any retroactive problems?

I have a valid H1B Visa which is expiring on Feb 16th, 2008 and my old H1 is expiring the same day as my Visa. I applied for my H1B extension my H1 extension is pending. I am planning to go to india on Dec last week and coming back on jan 7th.
1) Can I travel without any problems/
2) While coming back, what are the documents I need to show, will my old H1 is enough or do I have to show receipt of showing I applied for extension?

In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

I think mom's in the forum can answer this better since i am sure many of them took short term disablity during delivery and subsequent months. My wife took it twice for the birth of our children and I dont think it is an issue.

I am currently in H1-B. My GC (EB2) is in progress sponsored by my company.
The I-40 is approved but me and my wife�s I-485 is still pending.
We both got our EADs, but we have never-ever used it. We just applied for it and kept the card.
My wife was also on H1-B through her own employment. She got laid off so she is losing her H1-B. Now I want to apply for her H4 as my dependant. Since she already has an EAD, will applying for H4 nullify the EAD? As I said earlier that she has never used her EAD however she plans to use it when she gets a new job.
Anybody in similar situation? Any remarks or suggestion would be greatly appreciated.

How do you know that your case has been transferred from NSC to TSC.
Receipt has address of issuing office at the bottom of it. I also had nothing showing up in the system until yesterday, but today, our EAD's are in the system, but not I-485 or I-131. Perhaps EAD is considered a priority.

I am on J1 visa and have received a home residency requirement waiver. Do the experts here know if I can apply for a J1 visa extension (after receiving the waiver)? I read somewhere that it may not be possible to do so.
Also, are there are any foreign travel restriction on a J-1 visa?

Getting a waiver implies that you want to change your status. So renewal may not be a good idea. I would talk to a lawyer about the implications.

I dont think that holds true. If you follow you'll see they have been approving cases even in December for 2003 when the PD has been retrogressed to 2002 for December.
