Hi Folks,
My friend's 485 is pending with CIS and he is working on EAD. He currently does not hold any other visa. In fact his last H1 expired more than a year ago. We recently tried to renew his EAD online on USCIS website. However, we were stumped by a question which asks the applicant about his/her current immigration status in US. It was a drop down box and had many options like H1, L1 etc, but there was no option for somebody like him whose current status is just "AOS pending".
How do we get around this? Do you think it is best to apply on paper?

My lawyer said it was ok and we have applied for h4 extension for spouse. Its under regular processing at VSC so I won't know the outcome for a few months.

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.
Is there way for us or our lawyer to get receipt no. for my spouse's H4 application?

How can we help ourselves to get 2 year AP ? IV admins, can you kindly share with us any info regarding this ?
I know at this moment everyone is looking at the stimulus plan and economy, but , in the mean time we can prepare ourselves with some plan of action...
May be we should push for 3 year EAD/AP . Our argument should be, if we are 3 or more years away ( like EB3 India is currently 2001 or something ), we should get 3 year EAD/AP
Not meant to talk only for EB3 community, but in general as well.
Any thoughts IVians ?

I was on H1B until Feb 2009 and I applied for COS to H4 in Feb 2009. USCIS has received my COS application, and it is still pending with USCIS for 2 months now.
1. Can a new employer apply for a new cap-exempt H1B for me (technically a transfer, as I was on H1B for 2 years before)?
2. In that case, do I need to submit paystubs and W2s from when I last held H1B status?
Thanks in advance for your comments.

i got married with my husband right before he filed his i-485, so we can file it together. His i-485 recently got approved, mine is still pending since March 2007. After speaking with IO, I found out that my name check is pending. My name is not common, I had no interaction with a law agencies in any way. So, I suspect that name check is just an excuse.
My question is, can my marriage to my husband just before i-485 filing be a reason I am still waiting? Has anybody experienced something like this? I'm not from a country where arranged marriages are common practice and we have a child together.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

My GC was applied with employer A in Nov-2005. 485 applied during July 2007 fiasco. Even though I have EAD/AP, I have always maintained H1B status.
Recently got H1B transferred to employer B and its approved for 3 years.
My H1B visa (from employer B) will expire this month.
Can I make a trip to India and re-enter using AP, and still maintain H1B status?
I dont want to go through the hassle of going for H1B visa stamping for 10th to 12th year.
