Guys, I need ur suggestion and experiences on my typical situation

I am in the process of going full time with my client.

I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.

my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.

My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.

Was anybody in a similar situation ?

I don't want to take a risk by using EAD and my wife loosing H4 status.

Please advice

I know ability to pay issue is analyzed at I-140 stage, but the ability to pay the proffered wage begins at priority date and ends at the time I-485 is approved.

After I-140 approval, could be ability to pay examined again?

I read that someone went to an interview and was asked for sponsor company's taxes in order to check if the company still had ability to pay the salary.

Would be possible an RFE asking for updated financials of the company?

there are two choices for - I140 Filing Type
- Regular
- Premium

What is the difference b/w two. Can EB3 candidate file for I140 Filing Type in Premium category.

I have appeared for interviews in toronto. They have not looked at my pay stubs in detail. The most they would go is to check if you are still employed with the same firm. Again, this said each case is different. Stuff like Employer reputation, qualification etc., surely helps.

Dear Members,

Recently my husband had received an RFE on I-485 requesting information about his employment verification letter. He had sent all documents back to USCIS and today, I saw an update on my case. The message read that case processing resumed and there will be a decision or update made in 60 days.

Do you know what kind of decision they usually make? Is it normal to have such statements written up for a denial or approval?


Any words of comfort would help. My husband is the primary applicant.

If I were going to spend over a year in a country which required a visa to visit (such as Nigeria), in order to study the local culture, which kind of visa would I need to obtain before hand? Business, work, study, visitor, etc?
