I got my checks encashed to day and when I looked at the status of my I-485 application online it says

On September 21, 2007, we received this EOIR29 NOTICE OF APPEAL FROM DECISION OF DISTRICT DIRECTOR, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. Can any one please explain what it means... Is this something related to 485 at all?... is it that I had figured the Receipt numbers wrongly(This particualar receipt number was tough to determine from the back of the check)..

I dont think this is going to affect non immigrant community (read as H1s, GC etc). This is all about politics to gain the support of rich and influential Indian American community for the DNC and upcoming elections.

My H1B transfer got denied on last month because of end client contract was not provided.
At this time, we are trying get to all contract details(start to end client) and file new h1b petition (CAP Exempt) on premium processing and Lawyers are suggesting me to go for Counslar Processing.
I want to know What are options have to selected on I-129 for counslar processing (I am going through Lawyer However, I want to ensure that we are selecting right one)
On I-129 Form, Part 2,
Question 2: Basis for Classification (Check one):
a. New employment (including new employer filing H-1B extension).
b. Continuation of previously approved employment without change with the
same employer.
c. Change in previously approved employment
d. New concurrent employment.
e. Change of employer
f. Amended petition
Question 5: Requested Action (Check one):
a. Notify the office in Part 4 so the person(s) can obtain a visa or be admitted.
(NOTE: a petition is not required for an E-1 or E-2 visa).
b. Change the person(s)' status and extend their stay since the person(s) are all
now in the U.S. in another status (see instructions for limitations). This is
available only where you check "New Employment" in Item 2, above.
c. Extend the stay of the person(s) since they now hold this status.
d. Amend the stay of the person(s) since they now hold this status.

The H-1B quota is slowing reaching its limit. The so-called advanced degree cap is now full and approximately 53,800 cases have been counted against the 65,000 allocated to the regular cap. USCIS has advised that those wishing to be counted against this year's cap should submit their applications as soon as possible.
A lot has been said about how much longer the H-1B quota has lasted this year. There's a been a lot of speculation about the reasons why the quota is still open. It's pretty obvious that the economic situation has led to a reduced number of filings, but less people talk about the other reason. USCIS is generally pretty skeptical about the H-1B program, believing that many candidates for H-1B are filing marginal cases. This has increased the number of requests for evidence that USCIS has issued this season as well.
While the open cap provides an opportunity for a late-season submission, H-1B applicants and their employers should be well aware of the scrutiny they may have to endure. I just finished an intership with a company that does essentially what you do, except that they are already established in the Philadelphia Area. I don't know much, but I think your best bet would be to contact local businesses that might need multimedia stuff. Also, put some time into making a really /really/ kickass site, being as it is what is selling your services.

Hi there.. I need some suggestions from you all. Please help.
I have applied for a green card thru my husband (we got married in Sep and applied for the green in Dec). Both of us are well qualified and are working. We submitted all the documents that are needed thru my lawyer. My finger print appotinment went fine. USCIS wanted some additional evidence for I 485 which they initially sent to us in Jan and we never received it but we followed it up and got the notice 3 weeks ago. They wanted us to submit recent tax return form (my husband's) which is 2008. For 2009 we are filing together and my husband hasnt received his K1 forms yet (he is self employed - Physical therapist) so we filed for an extension of time for filing which he usually does every year. We submitted last year's tax return (both his and mine), extension form that we submitted to IRS, additionally we submitted my W2, my pay stubs and a letter from my employer about my employment. Last week we received a denial notice for I 485, I 131 and also for travel document. The reason mentioned was we didnt submit the evidence they asked for which is federal tax return form for the most recent tax year. For us its 2008 and for 2009 we submitted the extension form. My lawyer is going to submit a motion to reopen. Any one had similar situation? Please help.
For I 130 (which is not denied but is placed on hold for additional evidence), they wanted more evidence that we are still married! which came along with the denial notice. We have all the documents that they wanted. Also we are going to have a baby in AUG, so submitting a letted from my clinic too. This should be sent sometime next week.

To answer your second question, yes, the employer can revoke your I-140 petition which could result in denial of I-485 application. You are only covered under AC21 if your I-485 has been pending for more than 180 days as the previous poster suggested.

Even if they do issue an update today..so what? It means nothing. NSC issued an update it finished receipting July2nd filers 2 weeks back, and even today July 2nd filers get checks cashed.....

My lawyers para legals screwed up my case and sent the initial application
to California instead of Nebraska:mad:.
My case was filed on jul 30,but till now I have not received anything.
While all my friends, colleagues have received their receipt notice and finger print. On calling CSC they refused the divulge anything and told me to wait for 90 days. My lawyer says it will be processed and my case is safe. But I do not trust him as he is the one who screwed it up.
Is there anyone else whose applicationwas sent to the wrong service centre
and if so have they received their receipt notices?
This is for all the gurus out here in this forum. What are your views?
Will my application be accepted by USCIS and which centre will it be processed.

Why don't you go and get the visa stamped in chennai consulate or wherever it is applicable to you.
If you have an AP you don't have to worry about anything since you can use it when you come back.

1. Have a route map .. so people know clearly where they need to go .. which direction .. and pause for how long.
2. The event needs to start on time .. 5-10 mins here and there is fine .. but we need to start on time.
3. Send all IV members in that area .. email templates about the rally that they need to forward all folks they know. If everyone gets 2 friends .. and those 2 get 2 more .. we have a large number.
Get folks from other immigration forums as well. We had chinese folks with us .. and I think they were from some other forum/group.
check will all local groups so that there can be a show of strength !!
